The Vital Score Application collects information from patients at their doctor visit, helps doctors and patients have a conversation about the results, and provides patients with health and wellness information and resources that the practice offers, as along with an option to receive customized text and email messages that support a healthy lifestyle.

THE INFORMATION WE COLLECT
In order to for you to obtain the most benefit from our Application, we will collect information from health care providers (i.e. doctors, nurses, etc.) and their patients. "Aggregate Information" is information that describes the habits, usage patterns, and demographics of all users as a group but does not describe or reveal the identity of any individual user. “Personally Identifying Information” is information that personally identifies an individual user such as, name, medical record number, address, mobile phone number and email address.
For Health Care Providers:
Health care providers will submit information about their patients (specifically, their patients’ medical record numbers) and themselves (e.g., names, email addresses, practice name and the type of practice, practice address and phone number, the health and wellness information or resources they offer, and the password they’ve chosen to securely access their practice and patient information in the Application,). The only Personally Identifying Information Vital Score will have for a health care provider is his/her name, email address, practice name, practice phone number and practice address.
Patients will submit information about themselves to the Application, in response to a series of health-related questions about their gender, height, weight, tobacco use, alcohol use, physical activity level, sleep habits, and certain medical conditions or symptoms. In addition, to order to use the text and email messaging components of the Application, patients can choose to submit their mobile phone number and email address. (See “how you can consent to receive email and text message services”.) The only Personally Identifying Information Vital Score will have for a patient is his/her medical record number, mobile phone number and email address (if provided), and the patient’s responses to the text messages and emails facilitated by our Application.
HOW WE USE THE INFORMATION WE COLLECT
For Health Care Providers:
When a health care provider submits information to the Application, Vital Score will use, access, retrieve and store that information in order to make it available, viewable and potentially deliverable through the Application.
When a patient submits information to the Application by answering the health-related questions he or she receives in the Application, Vital Score, Inc. will use, access, retrieve and store that information in order to make it available, viewable and potentially deliverable only to the patient’s health care provider through the Application. In addition, Vital Score will use the information a patient submits through the Application to send, via text message, or email, health and wellness-related information that the patient requests or to offer or suggest other relevant products or services offered through Vital Score, Inc. or the patient’s healthcare provider. Vital Score stores all Personally Identifying Information securely and separately from the health information.
De-identified Health Information & Aggregate Information.
Vital Score will use the health information (which is not linked to any Personally Identifying Information) and other Aggregated Information that are not tied to any specific user for: improving the Application and fine-tuning any health and wellness-related offerings; for research purposes; for reporting to health care providers; or for identifying and reporting health trends.
Carriers for Cell Phones and Other Mobile Devices.
Patients may elect to receive text messages or emails that will be routed to the patients’ mobile phones or other electronic devices. Each mobile phone carrier will have their own privacy policies for their plan members. Vital Score recommends that you review the privacy policies of your particular carrier and that you exercise caution in the types of information you share with Vital Score through text messages or emails. Vital Score, Inc. is not responsible for the privacy policies of any patient’s or health care provider’s mobile phone carrier.
HOW WE MAY SHARE THE INFORMATION WE COLLECT
Vital Score may sell, transfer or otherwise share some or all of its assets, including any information we collect from you, in connection with a merger, acquisition, reorganization, change in control, or sale of assets or in the event of bankruptcy.
Vital Score may use and share Aggregate Information with other parties without restriction in connection with our business.
Vital Score reserves the right to disclose your Personally Identifying Information in the following circumstances: (i) As required by law, such as to comply with a subpoena or similar legal process; (ii) when we believe in good faith that the disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or, respond to a government request; (iii) to any other third party with your prior consent to do so.
Vital Score uses third parties such as a Cloud Hosting provider to securely host your Personally Identifying information and a Mobile Text provider to send out electronic text messages on our behalf. Additionally Vital Score may work with subcontractors to administer the Services in a Provider’s office or further develop the application. We will share your Personally Identifying information only as necessary for the third party to provide that service. Information disclosed to third parties will be limited to the minimum necessary to perform their task and may not be re-disclosed to others by those third parties.
HOW YOU CAN CHANGE OR DELETE YOUR CONTACT INFORMATION
As a health care provider, if you would like to: (a) update or delete your contact information; (b) opt-out or request that we cease sending you information; or (c) address any other question or concern you may have, please write to us at firstname.lastname@example.org and put in the subject line: “Change My Provider Info”.
As a patient, if you would like to: (a) update or delete your contact information; (b) opt-out or request that we cease sending you information via text message or email; or (c) address any other question or concern you may have, please write to us at email@example.com and put in the subject line: “Change My Contact Info”.
There are additional ways that you may opt out from receiving promotional communications from us concerning the Application. For example, patients may opt-out at any time by using the unsubscribe mechanism within the text message or email received. We will implement your opt-out request within five (5) business days of receipt in most instances, but shall not be liable for our failure to do so within this time frame. Your mobile phone number will not be retained for future use. As a patient, if you would like to update or change your health information records, please contact your healthcare provider.
A health care provider may cancel the subscription at any time. If a health care provider chooses to cancel his or her account, the removal of provider and patient data from Vital Score systems will be governed by the Business Associate Agreement with that provider. However, any research conducted prior to the deactivation of that health care provider’s account will still include the health care provider’s and that health care provider’s patients’ data.
HOW WE PROTECT YOUR PERSONALLY IDENTIFYING INFORMATION
Vital Score has implemented commercially reasonable security measures (including physical, electronic and procedural measures) in place to help safeguard your Personally Identifying Information from unauthorized access and disclosure and to protect against the loss, misuse and alteration of the information under our control. For example, only authorized employees and authorized third-party service providers are permitted to access Personally Identifying Information, and they may do so only for permitted business functions. In addition, we use encryption in the transmission of sensitive Personally Identifying Information between the health care provider’s system and ours. We also use encryption of the data at rest and physically separate Personally Identifying Information from health information.
A health care provider is solely responsible for any and all activities that occur under his/her username and password. Similarly, patients should take precautions in the use and management of their cellular phones or other mobile devices.
Please note that the technical processing and transmission of Personally Identifying Information may involve transmissions over various networks and changes to conform and adapt to the technical requirements of connecting networks or devices. Personally Identifying Information may be transferred to, and maintained on, computer networks located outside of the state, province, country or other jurisdiction in which you reside, and the jurisdiction in which these computer networks are located may not have privacy laws as protective as the laws in your jurisdiction.
Vital Score intends to only operate for jurisdictional purposes within the United States. When you utilize this Application, you agree that, for all purposes connected with this Application, you are interacting with a United States company only.
HOW YOU CAN CONSENT TO EMAIL AND TEXT MESSAGES
Vital Score, Inc. may be required by law to send Communications to you that may pertain to the Application and any other products and services you choose. If you provide your mobile phone number and email address, you consent to receiving text messages and emails delivered using our Application (by performing this action, you are signing up for recurring messaging from Vital Score). There is no purchase necessary. You understand that you may be charged to receive or send text messages by your mobile carrier (message & data rates may apply) and that Vital Score will inform you how to opt out of text messages (Text HELP for info. Text STOP to opt out), and emails at the time of sign-up and periodically within the text messages and emails you receive. You consent to receive these Communications electronically. The term “Communications” in this Section means any notice, record, agreement or other type of information that is made available to you or received from you in connection with the Application and the products and services you choose to receive from us.
You must be 18 years of age or older to use this Application. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at firstname.lastname@example.org. We will delete such information from our files within a reasonable time.
